Terms & Conditions

The following terms and conditions apply to all design services offered by Lemonberry Design / Lisa Hall. By requesting services from Lemonberry Design / Lisa Hall you are agreeing to the following terms and conditions, whether or not you have been provided with a copy.

Copyright

Lisa Hall, owner of Lemonberry Design, owns the copyright of all content, materials, logos and design elements from within www.lemonberry.com, unless otherwise stated. These elements may not be copied, reproduced, rewritten, published or altered in any way without written permission from Lisa Hall.
On completion of any commissioned design work, full copyright is passed to the client once payment has been received in full. However, Lemonberry Design retains the right to use the final artwork in any portfolios or for marketing/advertising of our services, both on and offline.
Source files remain the property of Lemonberry. If you would like to purchase source files (Illustrator/Photoshop/Indesign) please request a quote.
The copyright of any earlier concepts or design ideas that may have been supplied to you to preview remains with Lemonberry Design. We retain the right to use such initial concepts in future projects.

Single Point Of Contact

Client will provide a single point of contact for Lemonberry Design who will be responsible for collecting and providing needed assets and information to Lemonberry Design.

Price Changes

Lemonberry Design reserves the right to change prices at any time without notice. However, if a client has already commissioned any services from Lemonberry Design prior to any change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.

Cancellation Rights

Lemonberry and the client have a right to cancel your order at any time. In the event of cancellation you will be invoiced for the cost of the work carried out so far based on our hourly rate. If no work was completed, you will not be charged.

Time-frame

The time frame on each project is given as a concrete boundary for the project. It also encourages both Lemonberry and the client to continue communication to complete the project within the time frame. If the client fails to give a review of the drafts in a timely manner, or if assets are not received in the agreed time frame and the project stalls, you will be invoiced for the cost of the work carried out so far based on our hourly rate.

Content

As stated in my contracts, content MUST be completed and given in one time before the project starts and if it falls outside the original time-frame, the site will be completed without content.
If content needs to be adjusted or edited after the project time scale has been completed, this additional work will be charged at an hourly rate.

Payment

Lemonberry Design accepts payment by bank transfer within 14 days of the date on the invoice. Late payment is subject to a 10% administration charge.
We reserve the right to withhold final design files or withdraw all web pages until full payment has been received for a project.

Recommended Suppliers

Lemonberry Design may recommend third party suppliers to work along side us on your design project. These may include graphic designers, photographers, marketing consultants, SEO consultants, printing firms, copywriters and web developers. Should any of these companies be required, we will be happy to liaise with them on your behalf for a small project management fee. Lemonberry Design will not be held responsible for any problems or delays that may occur from using suppliers recommended by us.

Security

Lemonberry Design uses firewall and virus checking software to ensure the security of any emails or files we may send to you, from the external threat of hackers and virus infection.

Hosting

If you choose not to take hosting with Lemonberry Design, then we cannot be held responsible for any downtime of your site, or problems encountered with your hosting. Lemonberry Design would always prefer hosting your website as there are processes in place to monitor up-time of sites.
If you have arranged your own hosting, we will require access to an FTP account on your hosting site in order to upload your website.
If you would like to transfer your site from Lemonberry wp.Manage to third party hosting, we will provide a full copy of your site so you may transfer the site.

Website Success clause

Lemonberry accepts no liability for the Client’s sales, revenue, and/or the success of the Client’s website/business directly, indirectly, or consequently.

Third-party WordPress software

Lemonberry is not responsible for third party plugins that are recommended and used on your site. If a plugin begins to work in an unexpected manner or stop working as it was intended to, then of course Lemonberry will troubleshoot the problem at the usual support rate.

Design Service Terms

Lemonberry Design reserves the right to refuse to commit to any project that we may judge as unfit due to content or otherwise.
The acceptance of a project shall be deemed as a contractual agreement between the client and Lemonberry Design. We cannot always guarantee to start work immediately on a project but will inform the client of estimated timescales upon acceptance of the project.
Photographs, images and text supplied by the client must be the clients own or licensed for use by the client. Lemonberry Design cannot be held responsible for any breach of copyright or any other right caused by reproduction of materials supplied by the client.
The copyright for all material provided by Lemonberry Design, such as graphics, photographs and text, will remain the property of Lemonberry Design until full payment has been made.
All payments are non-refundable and required even if deliverables are not used by client.

Privacy Policy

Lemonberry Design is committed to protecting your privacy. Any information we collect from you is used only to process your order and to provide you with the best possible service.
We will not email you in the future unless you have given us your consent or there is a problem with your website/design which we need to address.
The information we will collect from you in order to work on your design project includes your name, address, phone number, and email address.
The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies, please let us know and we will delete or correct it promptly.
